Cookie & Tracking Technology Policy
This Cookie & Tracking Technology Policy ("Policy") explains what cookies and similar tracking technologies are, how Performance Footing ("we," "us," or "our") uses them on PerformanceFooting.com (the "Site"), the legal basis for their use, and the choices available to you. We are committed to transparency and respect your right to control how your information is collected online.
1. Cookies and Similar Technologies Defined
Cookies are small text files that a website places on your browser or device when you visit. They allow the site to recognize your device, remember preferences, and collect usage data across sessions.
Similar technologies include, but are not limited to, browser local storage, session storage, IndexedDB entries, pixel tags (also called web beacons or clear GIFs), JavaScript tags, embedded scripts, and entity tags (ETags). Where this Policy refers to "cookies," it encompasses all such technologies unless the context requires otherwise.
2. Categories of Cookies We Use
We classify the cookies deployed on the Site into two categories so that you can make a clear, informed choice:
2.1 Strictly Necessary (Essential) Cookies
These cookies are indispensable to the basic operation of the Site. They enable core functionality such as page navigation, secure session management, shopping-cart persistence, load balancing, and fraud prevention. Because the Site cannot function properly without them, strictly necessary cookies are exempt from consent requirements under applicable law and are always active. They do not collect information that is used for marketing or profiling purposes.
2.2 Analytics & Performance Cookies
These cookies help us understand how visitors interact with the Site—which pages are visited most frequently, how long visitors remain, and where errors occur. The insights allow us to improve Site performance, content, and navigation. Analytics cookies are set only after you provide consent where consent is required by applicable law (see Section 3 below). We currently deploy Google Analytics 4 (GA4) for this purpose.
3. Legal Bases and Your Choices
3.1 Consent-Based Jurisdictions
If you visit the Site from a jurisdiction that requires prior, affirmative consent before non-essential cookies may be placed—including the European Economic Area (EEA), the United Kingdom, Switzerland, Brazil, and Canada—you will be presented with a consent banner on your first visit. No analytics identifiers or tracking scripts will execute until you affirmatively opt in. You may accept or reject analytics cookies at that time and may change your preference at any time by clearing the Site's cookies in your browser settings; the consent banner will reappear on your next visit.
3.2 Notice-and-Opt-Out Jurisdictions (United States)
Under the California Consumer Privacy Act / California Privacy Rights Act (CCPA/CPRA) and the privacy statutes of more than nineteen additional U.S. states with comprehensive consumer-privacy laws as of 2026, you have the right to opt out of the sale or sharing of personal information and targeted advertising. Analytics cookies on this Site may load by default in the United States; however, you may exercise your opt-out right at any time through the following mechanisms:
- "Do Not Sell or Share My Personal Information" link. A clearly labeled link is available in the Site footer and on our consent interface, enabling you to opt out of any data sharing that could constitute a "sale" or "sharing" under applicable state law.
- Global Privacy Control (GPC). We honor the Global Privacy Control browser signal. As of 2026, twelve or more U.S. states—including California, Colorado, Connecticut, Texas, Oregon, Delaware, Montana, New Hampshire, New Jersey, Maryland, Minnesota, and Nebraska—legally require businesses to treat a GPC signal as a binding opt-out request. When the Site detects a GPC signal from your browser, we will automatically suppress any sale, sharing, or targeted-advertising activity for your session without requiring any further action on your part.
- Browser-level controls. You may also configure your browser to block or delete cookies. Most modern browsers allow you to manage cookie preferences through their settings menus. Note that disabling strictly necessary cookies may impair Site functionality.
3.3 Withdrawing or Changing Consent
Regardless of your jurisdiction, you may withdraw or modify your cookie preferences at any time by clearing the Site's stored data in your browser. Upon your next visit, the consent mechanism will reset and you may make a new selection. We will not penalize you or degrade your experience for exercising any opt-out right.
4. Third-Party Services and Data Processors
4.1 Google Analytics 4 (GA4)
We use Google Analytics 4 with the following privacy-protective configurations:
- IP anonymization. GA4 anonymizes IP addresses before storage, preventing Google from recording your full IP address in connection with Site activity.
- Google Consent Mode v2. The Site implements Google Consent Mode v2, which adjusts how Google tags behave based on your consent status. When you have not consented, no analytics identifiers are set, and Google's tags operate in a limited, cookieless mode that does not allow individual-level tracking.
- Data retention. GA4 event data is retained for a maximum of fourteen (14) months, after which it is automatically deleted.
4.2 Future Third-Party Technologies
We may integrate additional measurement or marketing tools in the future (for example, Meta Pixel, LinkedIn Insight Tag, or similar services). Any such technology will be governed by the same consent framework described in this Policy: it will not execute in consent-based jurisdictions until you opt in, and it will be suppressible via the opt-out mechanisms described in Section 3.2 in notice-and-opt-out jurisdictions. We will update this Policy before any new tracking technology is deployed.
5. "Do Not Sell or Share My Personal Information"
Performance Footing does not sell personal information within the ordinary meaning of that term. We do not receive monetary consideration in exchange for consumer data.
We do not share personal information with third parties for the purpose of cross-context behavioral advertising. To the extent that the placement of analytics cookies could be construed as a "sale" or "sharing" of personal information under the CCPA/CPRA or comparable state statutes, rejecting analytics cookies through our consent interface, clicking the "Do Not Sell or Share My Personal Information" link, or enabling a GPC signal in your browser will satisfy your opt-out rights under those laws.
We do not use or disclose sensitive personal information for purposes other than those expressly permitted under applicable law.
6. Children's Privacy
The Site is not directed at individuals under sixteen (16) years of age. We do not knowingly collect personal information from children. Under the CCPA/CPRA, if we have actual knowledge that a visitor is a minor between thirteen (13) and sixteen (16) years of age, we will not sell or share that individual's personal information without affirmative opt-in consent. For visitors under thirteen (13), we require verifiable parental or guardian consent before any such processing.
7. Data Retention
Strictly necessary cookies expire at the end of your browsing session or within a short fixed period necessary for their operational purpose. Analytics cookies persist for up to fourteen (14) months from the date of your last interaction, consistent with our GA4 retention settings. Consent-preference cookies are retained until you clear your browser data.
8. International Transfers
If you access the Site from outside the United States, please be aware that data collected through cookies may be transferred to and processed in the United States, where data-protection laws may differ from those of your jurisdiction. Where required by law (such as under the GDPR or UK GDPR), we rely on appropriate safeguards—including standard contractual clauses or equivalent mechanisms—to ensure an adequate level of protection for your personal data.
9. Changes to This Policy
We may update this Policy from time to time to reflect changes in technology, applicable law, our business practices, or the third-party services we use. When we make material changes, we will update the "Effective Date" and "Last Reviewed" dates at the top of this document and, where appropriate, notify you through a revised consent banner or a prominent notice on the Site. We encourage you to review this Policy periodically.
